Essentially, the Settings Rule has defined the characteristics of a HCBS setting. It asks providers who are reimbursed through HCBS waivers to demonstrate that they are in fact, a HCBS setting and not an institution, and that they meet the HCBS Standards. Full compliance by states is required by March 17, 2022. Initial activity has occurred to gather information around compliance with the Standards. Methods to assure ongoing compliance with the standards is being built into protocols for provider enrollment revalidation, client experience surveys and other processes. This webinar introduces the HCBS Standards, important background on the Settings Rule itself, how to request a modification to a person’s rights under the rule, and resources and tools to assist you as a provider to remain in compliance.
